State regulatory models for hemp-based intoxicants
While hemp-derived intoxicants were unexpected in many jurisdictions, not all were left without regulatory solutions. Here is a quick rundown of approaches we’ve seen so far, and how they appear to be doing.
Louisiana. Louisiana has not adopted adult-use legalization laws, yet state lawmakers understood in 2019 that intoxicants could be derived from hemp. Despite its anti legalization position, they nonetheless decided intoxicants made from hemp would be allowed, and they would need to be specifically regulated. A measure passed that year that established the groundwork for the regulatory system we see today - the country’s most advanced. It was recently updated in June of 2022. Virginia. Passed in 2020, the state law created a foundation for cannabinoids, and recently-passed rules clearly allow for intoxicants for adults. Our Virginia one-pager is here.
Minnesota. The state adopted a program that allows up to 8mg THC per serving, so long as it ain’t delta-9 THC, and it comes from a hemp plant.
